Welcome to Januscaler! These Terms and Conditions ("Terms") govern your access to and use of Januscaler’s WebRTC services (the "Service"). By using our Service, you agree to these Terms. If you do not agree, you may not use the Service.

1. Definitions

  • "Company": Refers to Januscaler, the provider of the WebRTC Service.
  • "Customer": Refers to the business entity using the Service.
  • "Account": Refers to the registered account created by the Customer to use the Service.
  • "API": Refers to the application programming interface provided by Januscaler.
  • "Content": Refers to any data, audio, video, or other materials transmitted using the Service.

2. Eligibility

The Service is intended for business entities. By using the Service, you represent and warrant that:

  • You are authorized to act on behalf of your business entity.
  • Your use of the Service complies with all applicable laws and regulations.

3. Account Registration

  • You must provide accurate and complete information when creating an Account.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • You are responsible for all activity conducted under your Account.

4. Use of the Service

  • The Service is provided "as is" and "as available."
  • You must use the Service in accordance with all applicable laws and these Terms.
  • You must not:
    • Reverse-engineer or attempt to extract source code.
    • Use the Service to send unlawful, harmful, or malicious Content.
    • Interfere with the integrity or performance of the Service.

5. Fees and Payment

  • Fees for the Service are calculated based on usage as outlined in the invoice.
  • Invoices are issued at regular intervals or after specific usage thresholds are reached.
  • Payment must be made via the methods outlined in the invoice.
  • Late payments may result in suspension or termination of your Account.

6. Intellectual Property

  • The Company retains all rights, title, and interest in the Service, including all associated intellectual property.
  • You may not use the Company’s trademarks, logos, or other proprietary information without prior written consent.

7. Data Privacy and Security

  • The Company will process any data in accordance with its Privacy Policy.
  • You are responsible for ensuring the security and privacy of any data you transmit using the Service.

8. Customer Responsibilities

  • Ensure your use of the Service complies with applicable laws, including data protection regulations.
  • Obtain and maintain all necessary permissions for data you transmit using the Service.

9. Service Level Agreement (SLA)

  • The Company will make commercially reasonable efforts to ensure availability of the Service.
  • Planned downtime will be notified in advance.
  • The Company is not responsible for service interruptions caused by:
    • Third-party providers.
    • Acts of God or other force majeure events.

10. Limitation of Liability

  • To the maximum extent permitted by law, the Company is not liable for:
    • Indirect, incidental, or consequential damages.
    • Loss of profits, revenue, or data.
  • The total liability of the Company will not exceed the amount paid by the Customer in the 12 months preceding the event.

11. Indemnification

You agree to indemnify and hold the Company harmless from any claims, damages, or expenses arising from:

  • Your use of the Service.
  • Your violation of these Terms or applicable laws.
  • Content you transmit using the Service.

12. Term and Termination

  • These Terms remain in effect as long as you use the Service.
  • The Company may terminate your Account if:
    • You breach these Terms.
    • You fail to pay fees owed.
  • Upon termination, your access to the Service will cease immediately.

13. Governing Law

These Terms are governed by the laws of India, without regard to its conflict of law principles.

14. Changes to Terms

The Company may update these Terms from time to time. You will be notified of any material changes. Continued use of the Service constitutes acceptance of the updated Terms.
